  • Instructions were received pre-lease expiry to provide initial diminution advice on behalf of the NHS in respect of a former Medical Centre
  • The Landlord had served a Claim at £172,000
  • Our initial advice was that the property was likely to either be demolished or repurposed in some way (alternative use) that would supersede all of the Claim. In other words, there was no Diminution
  • Landlord instigated legal proceedings to pursue the Claim as they felt the value they achieved had been diminished
  • Subsequently we were instructed to represent the former Tenant as Expert Witness
  • We provided an Expert Report and attended a Trial to be extensively cross-examined
  • The Judgement was received agreeing with our conclusions and subsequently determining there was £nil loss to the Landlord’s reversionary value, and as such, there was no Claim
